Terms and Conditions for Ahearns Recruitment and Staffing

1. Introduction

Welcome to Ahearns Recruitment and Staffing, a staffing and recruitment agency. These Terms and Conditions govern your use of our services. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please refrain from using our services.

2. Definitions

  • Client: Any company or organization that engages Ahearns Recruitment and Staffing      for staffing and recruitment services.
  • Candidate: Any individual who applies or is referred for employment opportunities      through Ahearns Recruitment and Staffing.
  • Service: The staffing, recruitment, and related services provided by Ahearns      Recruitment and Staffing.

3. Services Provided

  • Ahearns Recruitment and Staffing acts as an intermediary between Clients and      Candidates, sourcing and matching Candidates based on Clients' requirements.
  • The scope of services includes temporary, contract, and permanent staffing solutions.
  • Ahearns Recruitment and Staffing does not guarantee the suitability, qualifications, or availability of Candidates for specific roles.

4. Client Responsibilities

  • Clients must provide accurate and complete job descriptions, qualifications, and      other relevant information for the positions to be filled.
  • Clients are responsible for verifying Candidates' credentials, qualifications, and references.
  • Any employment offer, terms of employment, and other contractual agreements      with Candidates are solely at the Client’s discretion.

5. Candidate Responsibilities

  • Candidates must provide accurate information about their qualifications, experience,      and eligibility for employment.
  • Candidates are responsible for ensuring their right to work and any necessary permits      or visas.
  • Any false or misleading information provided by the Candidate may lead to      disqualification from the recruitment process.

6. Fees and Payment

  • Clients will be invoiced for recruitment services as agreed in the contract or      service agreement.
  • Payment terms will be defined in the service agreement, and all fees must be paid      within 30 days of the invoice date.
  • Late payments may incur interest charges as specified in the service agreement.

7. Guarantees and Replacements

  • Ahearns Recruitment and Staffing may offer a replacement guarantee if a Candidate      leaves within a certain period after employment (e.g., 30, 60, or 90      days).
  • Replacement guarantees are subject to specific conditions and do not apply if the      Candidate leaves due to company restructuring, layoffs, or other non-performance-related reasons.

8. Confidentiality

  • Ahearns Recruitment and Staffing will treat all client and candidate information as confidential and use it only for the purpose of recruitment.
  • Clients and Candidates agree not to disclose any confidential information obtained      through the recruitment process without written consent from Ahearns Recruitment and Staffing.

9. Data Protection

  • Ahearns Recruitment and Staffing is committed to complying with applicable data      protection laws.
  • Candidates and Clients consent to the collection, processing, and storage of personal      data as necessary for the provision of recruitment services.
  • Ahearns Recruitment and Staffing will take reasonable measures to protect personal      data from unauthorized access or disclosure.

10. Liability

  • Ahearns Recruitment and Staffing is not liable for any direct, indirect, incidental, or consequential damages arising from the recruitment process.
  • Clients are responsible for making final hiring decisions, and Ahearns Recruitment      and Staffing cannot guarantee employment outcomes or the performance of Candidates.
  • Ahearns Recruitment and Staffing will not be liable for any errors or omissions in      the information provided by Candidates.

11. Termination

  • Either party may terminate the service agreement with [number] days' written notice.
  • Ahearns Recruitment and Staffing reserves the right to suspend or terminate      services in the event of non-compliance with these Terms and Conditions.

12. Governing Law

  • These Terms and Conditions are governed by the laws of Newark, NJ, USA, and any disputes will be subject to the exclusive jurisdiction of the courts in Newark, NJ, USA.

13. Changes to Terms and Conditions

  • Ahearns Recruitment and Staffing reserves the right to modify these Terms and      Conditions at any time. Changes will be posted on the website and will become effective immediately.
